This website is operated by ROVE Dash Cam. Throughout the site, the terms “we”, “us” and “our” refer to ROVE Dash Cam. ROVE Dash Cam offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, or by downloading or using our mobile application (“App”), you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

By using the Service, you also agree to our Privacy Policy, Return Policy, and any applicable Limited Warranty, each of which is incorporated into these Terms by reference.

These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.


SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.


SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us.

Order Acceptance: Your order constitutes an offer to purchase. We reserve the right to accept or reject any order at our sole discretion. An order confirmation email does not constitute final acceptance of your order.

Risk of Loss: Title to and risk of loss for products pass to you upon our delivery of the products to the carrier.

We reserve the right to refuse any order you place with us. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store and to promptly update your account and other information.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement.

Certain content, products and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.


SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you send certain submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

Your submission of personal information through the store is governed by our Privacy Policy.


SECTION 11 - PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform or participate in any unlawful acts; to violate any regulations, rules, laws, or local ordinances; to infringe upon or violate our intellectual property rights or the intellectual property rights of others; to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; to submit false or misleading information; to upload or transmit viruses or any other type of malicious code; to interfere with or circumvent the security features of the Service.


SECTION 12 - MOBILE APPLICATION; DEVICE CONNECTIVITY

The ROVE mobile application (“App”) is provided to enhance your dash cam experience. By using the App, you agree not to reverse engineer, modify, or interfere with the software or device connectivity features.

The App may request access to features such as location services, local network access, camera, photo library, and notifications in order to provide functionality such as device connectivity, address entry, QR scanning, and media management. Disabling required permissions may limit functionality.


SECTION 13 - FIRMWARE AND SOFTWARE UPDATES

ROVE may provide firmware or software updates to improve performance, security, or compatibility. You acknowledge that updates may modify features or behavior, and failure to install updates may limit compatibility. Improper installation may impact device operation.


SECTION 14 - DASH CAM USE AND LEGAL COMPLIANCE

Dash cams are intended for lawful use only. You are responsible for complying with all local, state, and federal laws regarding audio and video recording, including consent requirements. ROVE is not responsible for how recorded footage is used or disclosed.


SECTION 15 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided “as is” and “as available” for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall ROVE Dash Cam, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service.

Limitation of Liability Cap: To the fullest extent permitted by law, ROVE Dash Cam’s total aggregate liability arising out of or related to any product or service shall not exceed the amount paid by you for the specific product giving rise to the claim.


SECTION 16 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless ROVE Dash Cam and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.


SECTION 17 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.


SECTION 18 - TERMINATION

These Terms of Service are effective unless and until terminated by either you or us. We may terminate this agreement at any time without notice if you fail to comply with any term or provision of these Terms.


SECTION 19 - ENTIRE AGREEMENT

These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service.


SECTION 20 - GOVERNING LAW; VENUE

Governing Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Venue: Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to personal jurisdiction in such courts.


SECTION 21 - DISPUTE RESOLUTION; BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

21.1 Informal Dispute Resolution

Before initiating arbitration, you agree to first contact us at help@rovedashcam.com and provide a written description of your claim. The parties agree to attempt to resolve the dispute informally for a period of thirty (30) days from the date notice is provided. Arbitration may not be commenced until this informal resolution process has been completed.

21.2 Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any product purchased from ROVE Dash Cam shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

The arbitration shall be conducted in the State of Florida unless otherwise required by law. The Federal Arbitration Act (“FAA”) governs the interpretation and enforcement of this arbitration provision.

21.3 Class Action Waiver

YOU AND ROVE DASH CAM AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.

If this class action waiver is found to be unenforceable, then the entire arbitration provision shall be null and void.

21.4 Jury Trial Waiver

YOU AND ROVE DASH CAM WAIVE ANY RIGHT TO A JURY TRIAL.

21.5 Small Claims Court Exception

Either party may bring an individual claim in small claims court if the claim qualifies and remains on an individual basis.

21.6 Arbitration Opt-Out

You may opt out of this arbitration agreement by sending written notice to help@rovedashcam.com within thirty (30) days of your first purchase or use of the Service. Your notice must include your full name, address, and a clear statement that you wish to opt out of arbitration.

21.7 Batch Arbitration Protection

To the extent permitted by law, if multiple substantially similar claims are filed against ROVE Dash Cam by the same counsel or coordinated parties, the AAA may consolidate or batch such claims as permitted under its rules.

21.8 Survival

This arbitration provision shall survive termination of these Terms and your relationship with ROVE Dash Cam.
